Terms of Service

These Terms of Service, together with the Creator Terms, the Terms of Purchase, the Content Policy, the Privacy Policy, the Cookie Policy and the Refund Policy, form the agreement between you and Hidden Gems ("Hidden Gems", "we"). By creating an account, publishing content, or buying a Gem, you accept this agreement. If you do not accept it, do not use the platform.

Hidden Gems lets creators package exclusive digital content into unlockable Gems and sell access to them through shareable links. Buyers unlock Gems with a one-time payment; no buyer account is required.

We provide the tools and the marketplace infrastructure. We do not guarantee sales, income, or any particular result for creators or buyers.

You must be at least 18 years old, or the age of majority in your country, to create an account or buy a Gem. You must provide accurate information and keep your credentials private — you are responsible for all activity under your account.

One person may not operate multiple accounts to manipulate rankings, awards, or payouts.

Creator Membership costs $9.99 per month, billed in advance and renewing automatically until cancelled. You can cancel anytime from your Studio; access continues until the end of the billing period.

On each completed sale, Hidden Gems retains a 20% platform commission. Card processing estimates (about 2.9% + $0.30 per sale) are charged by the payment processor, not by us. Payouts to creators follow Stripe's standard schedule.

You agree not to: break the law; infringe intellectual property; share anyone else's private data; abuse, harass, or defame others; scrape or mass-download the platform; interfere with its operation; or circumvent access controls, paywalls, or unlock mechanisms.

The Hidden Gems platform, brand, and software are ours. Creators keep ownership of the content they publish and grant us a worldwide, non-exclusive, royalty-free license to host, display, and deliver that content to buyers for as long as it remains published.

We may suspend or close accounts that violate this agreement, engage in fraud, or harm the platform or its users. You may delete your account at any time. Buyers keep access to content they legitimately purchased, even if a creator's account is closed.

The platform is provided "as is", without warranties of any kind. To the maximum extent permitted by law, our total liability for any claim is limited to the amounts you paid us in the 12 months before the claim arose.

We may update these terms as the service evolves. Material changes will be announced in advance; continued use after changes take effect means you accept them.

This agreement is governed by the laws of the State of New York, USA, without regard to its conflict-of-law principles.

Please contact support first — most disputes are resolved quickly that way. If we cannot resolve a dispute informally within 30 days, you and Hidden Gems agree to binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of a trial in court. The arbitration takes place in New York County, New York, or another location we both agree on, and may be held by phone or video conference.

You and Hidden Gems each waive any right to a jury trial and to bring or join any class, collective, or representative action. You may still file an individual claim in small-claims court where it qualifies.

You may opt out of this arbitration agreement within 30 days of first accepting these terms by emailing hello@hiddengemspay.com with the subject "Arbitration opt-out" and the email address of your account. If you opt out, disputes will be decided by the state or federal courts located in New York County, New York.
