Content Policy

Last updated: 2026-10-20

1. Scope

This policy applies to everything published on Hidden Gems: Gems, collections, creator profiles, public descriptions, and any message sent through the platform. If it's on Hidden Gems, it must follow these rules.

2. Prohibited content

Do not publish: anything illegal in your country or the buyer's; content you did not create and do not have the rights to share (including pirated media and reposted content presented as your own); any third party's private data — addresses, phone numbers, ID documents, financial details, or non-public personal information; deceptive content that promises what the Gem does not deliver; spam, scams, or phishing; hateful, harassing, or threatening material; or malware and malicious links.

Sexual content involving minors is strictly prohibited and will be reported to the authorities. All other content must also comply with our payment processors' acceptable-use rules — if Stripe won't process it, it can't be sold here.

3. Honesty in descriptions

The public title, description, and "what you'll receive" summary must accurately describe the locked content. Bait-and-switch descriptions are treated as fraud and lead to refunds charged back to your earnings.

4. Intellectual property

Respect copyrights and trademarks. Use only content you created or are licensed to sell. Repeat infringers lose their accounts; rights holders may file a DMCA notice as described in section 5.

5. Copyright complaints (DMCA)

Hidden Gems respects copyright and complies with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on the platform infringes your copyright, you may send a takedown notice.

A valid notice must include: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the infringing material, including its URL on Hidden Gems; (4) your contact information; (5) a good-faith statement that the use is not authorized by the owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the owner. Send notices to hello@hiddengemspay.com with the subject "DMCA takedown notice".

We will promptly remove or disable access to the material and notify the creator, who may file a counter-notification including their contact details, consent to the jurisdiction of the federal courts in New York, and a statement under penalty of perjury. If we receive a valid counter-notice, we may restore the material 10–14 business days later unless the complainant notifies us that a court action has been filed.

Creators who repeatedly infringe copyrights lose their accounts under our repeat-infringer policy. Knowingly submitting a false notice or counter-notice carries liability under 17 U.S.C. § 512(f).

6. Reporting content

If you see content that violates this policy, report it through the form on our Support page or by emailing hello@hiddengemspay.com with the Gem link and the reason. We review every report.

7. Enforcement

Violations may result in content removal, withheld payouts, account suspension, or permanent closure, depending on severity. Fraudulent sales are deducted from earnings. You may appeal any enforcement decision by contacting support.
